Terms and Conditions
These terms and conditions govern your use of this website and the services offered through it. By using the site, subscribing to our newsletter, or booking a session, you agree to these terms. Please read them carefully. If you do not agree, please do not use the site.
1. Who we are
This website is operated by Ivyn Sambo, trading as The Investor Chair ("we", "us", "our"). You can contact us at contact@ivynsambo.co.za. This disclosure is provided in line with the Electronic Communications and Transactions Act, 2002 (ECTA).
Important: education, not financial advice. Everything on this website, including the newsletter, podcast, videos, and one-on-one sessions, is provided for general financial education and information only. It is not financial, investment, tax, or legal advice, and it is not a recommendation to buy, sell, or hold any financial product. Ivyn Sambo is a financial educator and is not a registered financial services provider (FSP) under the Financial Advisory and Intermediary Services Act (FAIS). You should always do your own research and, where appropriate, consult a suitably qualified, FSCA-authorised financial adviser before making any financial decision. You act on any information at your own risk.
2. Use of the website
You agree to use the website lawfully and not to: misuse it, attempt to gain unauthorised access, interfere with its operation, upload harmful code, or use it in a way that infringes the rights of others. We may suspend or restrict access to the site at any time.
3. Intellectual property
All content on this website, including text, graphics, the wordmark and logo, photographs, videos, and the design, is owned by or licensed to Ivyn Sambo and is protected by law. You may view and share links to our content, but you may not copy, reproduce, republish, or use it for commercial purposes without our written permission.
4. The Chair Brief newsletter
When you subscribe to our newsletter, you consent to receiving emails from us. You can unsubscribe at any time using the link in any email. We handle your information as set out in our Privacy Policy.
5. Coaching and education sessions
We offer one-on-one financial education sessions, typically one hour long and delivered online via Google Meet. When you book a session, the following apply:
- Bookings are made through our third-party booking provider, and are subject to availability and confirmation.
- Sessions are educational and general in nature. They are not personalised financial advice (see section 1).
- You are responsible for having a suitable internet connection and device to join the session.
- Cancellations, rescheduling, and refunds are governed by our Return and Refund Policy.
6. Payments
Where a session or product is paid for, the price and payment terms will be shown at the time of booking or purchase. Payments may be handled by third-party payment or booking providers, subject to their own terms. You agree to provide accurate payment information.
7. Third-party links and services
The site links to and embeds third-party services (for example, YouTube, Spotify, Buzzsprout, and our booking provider). We are not responsible for the content, products, or practices of those third parties, and your use of them is subject to their terms.
8. Disclaimers and limitation of liability
The website and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the site will be error-free or uninterrupted, or that any information is complete or current.
To the fullest extent permitted by law, and subject to your rights under the Consumer Protection Act, 2008 (CPA), we will not be liable for any loss or damage (including any financial loss) arising from your use of, or reliance on, this website or its content, or from any decision you make based on it. Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited.
9. Indemnity
You agree to indemnify and hold us harmless against any claims, losses, or expenses arising from your breach of these terms or your unlawful use of the website.
10. Consumer rights
Nothing in these terms is intended to limit any rights you have under the Consumer Protection Act, 2008, the Electronic Communications and Transactions Act, 2002, or any other applicable law. Where any provision of these terms conflicts with those rights, your statutory rights prevail.
11. Changes to these terms
We may update these terms from time to time. The version published on this page at the time you use the site applies. We will change the "Last updated" date when we make changes.
12. Governing law
These terms are governed by the laws of the Republic of South Africa, and you agree to the jurisdiction of the South African courts.
